1. Acceptance of Terms

By accessing peptidepure.com, creating an account, or placing any order, you agree to be bound by these Terms and Conditions in their entirety. If you do not agree, do not use this platform. These Terms apply to all visitors, registered users, licensed clinicians, and wholesale account holders.

2. Nature of Products & Research Use

All peptides, biologics, and related compounds offered through Peptide Pure LLC are intended solely for legitimate research, observational study, and clinical use by licensed healthcare professionals. Products are NOT approved by the U.S. Food and Drug Administration (FDA) for human consumption, diagnosis, treatment, cure, or prevention of any disease or condition.

• Peptide Pure makes no therapeutic claims.
• Products must not be used by consumers for personal self-administration without the supervision of a licensed medical provider.

3. Eligible Users & Credentialing

Access to wholesale pricing and product ordering is restricted to:

• Licensed physicians, physician assistants, nurse practitioners, naturopathic doctors, and other duly licensed healthcare providers in their state of practice.
• IRB-approved research sites operating under a valid observational protocol.
• Authorized clinic administrators acting on behalf of a licensed provider.

Peptide Pure reserves the right to verify credentials, NPI numbers, and state licensure at any time and to deny or revoke access without notice.

4. IRB Participation & Compliance

Clinicians who enroll in the Mortensen Medical Research Network agree to:

• Enroll patients under current IRB-approved informed consent.
• Follow protocol MMRN-001-2025 data collection and adverse event reporting requirements.
• Submit required data electronically within 14 days of each patient visit.
• Accept oversight by the Institute of Regenerative and Cellular Medicine (IRCM) central IRB.

IRB participation is voluntary. Enrollment does not create an employment or agency relationship with Peptide Pure LLC or Mortensen Medical.

5. Orders, Pricing & Payment

All prices are subject to change without notice. Orders are not binding until confirmed by Peptide Pure in writing. We reserve the right to cancel any order for any reason, including but not limited to supply constraints, compliance concerns, or suspected misuse.

• Payment must be received in cleared funds prior to shipment.
• Peptide Pure does not guarantee availability of any product.

6. Shipping, Import & Customs

Buyer assumes all risk for import compliance, customs clearance, and applicable local regulations upon shipment. Peptide Pure is not liable for delays, seizures, or losses caused by customs authorities.

International and domestic regulatory requirements are the sole responsibility of the ordering provider or institution.

7. No Warranty; Limitation of Liability

PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

• To the maximum extent permitted by law, Peptide Pure LLC, its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of products or this platform.
• Total liability shall not exceed the amount paid for the specific order giving rise to the claim.

8. Indemnification

User agrees to indemnify, defend, and hold harmless Peptide Pure LLC, Mortensen Medical, and their respective officers, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

• User's misuse of products.
• User's violation of these Terms.
• User's violation of any applicable law or third-party right.
• Adverse patient outcomes arising from clinical decisions made by User.

9. Privacy & Data Use

Peptide Pure collects and processes account information, credentialing data, and order history for business operations and compliance purposes.

• Clinicians participating in observational registry protocols consent to de-identified data aggregation for research purposes in accordance with the applicable IRB protocol.
• No patient-identifiable data is transmitted to Peptide Pure without express consent.
• Use of the PeptidePure™ data capture tools is subject to a separate Data Use Agreement.

10. Intellectual Property

All content on peptidepure.com, including text, images, product descriptions, protocols, and proprietary blends, is owned by or licensed to Peptide Pure LLC. Unauthorized reproduction, redistribution, or commercial use is prohibited without written consent.

11. Termination

Peptide Pure reserves the right to suspend or terminate any account at its sole discretion, without notice, for violation of these Terms, regulatory concerns, or business reasons. Upon termination, all outstanding obligations survive.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute shall be resolved by binding arbitration in Ventura County, California, under JAMS rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

Class action waiver: User waives any right to participate in class action litigation.

13. Modifications

Peptide Pure reserves the right to update these Terms at any time. Continued use of the platform after notice of changes constitutes acceptance of the revised Terms. It is User's responsibility to review Terms periodically.
